Doctor James Gloor, of Wickford Junction Medical Walk-In in North Kingstown, RI, is currently under attack by the RI Department of Health and Board of Medical Licensure and Discipline for “Unprofessional Conduct” in his “mismanagement of the treatment of Lyme disease.”
It started in April, 2012, when Nicole Alexander, MD, an Infectious Disease physician at RI Hospital, ( a Lifespan facility), and also an active employee of the Department of Health sent an email throughout the Brown University and Lifespan network stating that Dr. Gloor was under investigation by the Board of Medical Licensure and ‘anyone with any knowledge of/contacts with patients that he had treated “ were encouraged to pass along any information in order to further the investigation!!
This act was not only an absolute blatant breach of confidentiality of the Board, but also indicative of a complete ignorance of the law by a member of the Department of Health. (That law, enacted by the General Assembly of Rhode Island in 2002 established two standards of care in the treatment of Lyme disease; protecting physicians who choose to treat with long-term antibiotics from prosecution.) The “Witch Hunt” had begun…!!!
Subsequently, six “complaints: were drummed up. Dr. Gloor retained an attorney that had been instrumental in drafting the above-mentioned law in order to respond to the illicit email and the complaints that supposedly were about “mismanagement of the treatment of Lyme”. At the first “informal” meeting with the Medical Director of the Board, Dr. James MacDonald and their attorney, Mr. Thomas Corrigan our attorney attempted to present an initial and general response to the allegations along with more than fifty letters of support from patients. The letters were handed back to him and Dr. MacDonald proceeded to tell Dr. Gloor directly that his are “the worst medical records I have ever seen.”
Mr. Corrigan who is not a doctor, asked Dr. Gloor, “Are you a hammer that sees everything as a nail?” It immediately became apparent that they had no interest in listening to Dr. Gloor’s side of the story as it pertained to his actual treatment of these patients, but rather they had already established themselves as “judge, jury and executioner” and would take the tact of punishing him for his medical records, since they knew they did not have a case when it came to his treatment of Lyme!
Their edict was that Dr. Gloor would have to undergo a medical record keeping course in Colorado for a week at a cost of >$10,000.00 or agree to a record monitoring program in the office on a monthly basis for 1 ½ to 2 years, also at an expenses of thousands of dollars a year, with no guarantee that they would be satisfied! These “options” would come in the form of a “Consent Order” that he would have to sign. This is a completely egregious and blatant abuse of power by this Department of Health and is the very same tactic used across the nation by Medical Licensure Boards in an attempt to silence or drive physicians out of practice who dare to disagree with the IDSA, (Infectious Disease Society of America). The same was done to Dr. Charles Ray Jones in Connecticut.
It is going to take a full scale legal battle to combat this assault on Dr. Gloor’s career and livelihood; an expense that far exceeds our financial capability and insurance allowance.
